NOTICE: THIS IS A LEGALLY BINDING AGREEMENT

Please read this document thoroughly. By signing below, you waive your right to bring a court action for personal injury, property damage, or any other remedy related to your attendance at the Riverdale Dunes Metropolitan District Swimming Pool, including any claims against affiliated entities, officers, directors, employees, and agents, both now and in the future.

Acknowledgment of Risk

By attending the Riverdale Dunes Metropolitan District Swimming Pool, I acknowledge and understand the inherent risks, including but not limited to:

1. Slips, trips, and falls
2. Aquatic injuries
3. Athletic injuries
4. Illnesses, including potential exposure to viruses or bacteria

This list is not exhaustive, and I understand it does not limit the scope of this Agreement.

Governmental Immunity

This Agreement does not waive any protections granted to the Riverdale Dunes Metropolitan District or its directors, officers, employees, agents, or authorized volunteers under the Colorado Governmental Immunity Act (Section 24-10-101, et seq., C.R.S.).

Assumption of Risk, Waiver of Liability, and Indemnification

By signing this Agreement, I, the undersigned participant (and on behalf of my family members, minor children, and guests), release and hold harmless Riverdale Dunes Metropolitan District, their officers, directors, employees, agents, representatives, and insurers ("Releasees") from all claims, demands, liabilities, or causes of action arising from personal injury, property damage, illness, or death related to my use of the Riverdale Dunes Metropolitan District Swimming Pool, including claims of negligence.

I acknowledge the risk of exposure to COVID-19 and understand such exposure could result in serious illness or death.

I agree to indemnify and hold the Releasees harmless from any legal actions, claims, or costs arising from my attendance at the Riverdale Dunes Metropolitan District Swimming Pool.

Please be advised that the Riverdale Dunes Metropolitan District Swimming Pool will now have a pool attendant on-site to monitor access. However, a lifeguard will not be present. Pool use is at your own risk.

 Certification

I certify that:

• I am of lawful age and legally competent to sign this Agreement.
• I am in good health and capable of safely attending the Riverdale Dunes Metropolitan District Swimming Pool.
• I fully understand the risks and voluntarily assume responsibility for any injuries or damages sustained while using the pool or participating in Riverdale Dunes Metropolitan District Swimming Pool activities.

I further understand that this Agreement is legally binding and sign it of my own free will.
